Processing of complaints


Complaints should be sent to the email address imn@imn.ac.cr, filling and attaching the corresponding form.

The Active Management of the Instituto Meteorológico Nacional (IMN), is empowered to receive and address complaints, why any citizen can file their complaints by this means. The information required in processing complaints is one that allows clarify the facts, period in which they occurred and whether any individuals responsible for their commission known. As stated in Article 6 of the General Internal Control (LGCI ), Act No. 8292, and Article 8 of the Law against Corruption and Illicit Enrichment in Public Service (LCCEI), No. 8422, the Active Administration ensures that:

  • Keep the confidentiality of whistleblowers.
  • They will not be retaliated against the complainant.
  • The effects of retaliation will be reversed against the person who undertakes, by applying appropriate sanctions

Within the following eligibility criteria are established:

  1. The facts alleged must be stated in clear, precise and circumstantial, providing sufficient detail to conduct the research, as well as the time and place in which such facts and the subject who allegedly did occurred.
  2. It should be noted investigate possible irregular, affecting state resources over which the IMN has jurisdiction situation.
  3. The complainant shall indicate its intention in relation to the facts alleged.
  4. The complainant will also provide additional information regarding the estimation of the financial damage caused to public funds if known, indication of likely witnesses and the place or means to quote them, as well as the contribution or suggestion of other tests.
Whistleblower.
The Active administration of IMN will process anonymous complaints in exceptional cases, provided that:

• The facts are set out in clear, precise and circumstantial, providing enough time to conduct the research (time and place of the facts and the subject who allegedly made) detail.

• With the complaint evidence that give merit to open officially received a preliminary investigation

Otherwise it will be filed without processing.
 

Whistleblower

The Active administration of IMN will process anonymous complaints in exceptional cases, provided that:

  • The facts are set out in clear, precise and circumstantial, providing enough time to conduct the research (time and place of the facts and the subject who allegedly made) detail.
  • With the complaint evidence that give merit to open officially received a preliminary investigation
Otherwise it will be filed without processing.


Complaints for Internal Administration

Internal Administration of IMN will process only those complaints that:

  • The facts are set out in clear, precise and circumstantial, providing enough time to conduct the research (time and place of the facts and the subject who allegedly made) detail.
  • The complainant indicate its claim in relation to the facts alleged.
  • Upon the filing of the complaint, during and after completion of the research process, it will remain protected the identity of the complainant at all times. However the judicial authorities and those who are entitled may request the relevant information to the possible existence of an offense against the honor of the person accused.


Communication

The complainant will be communicated any of the following resolutions to be adopted for its management:

  • The decision to dismiss the complaint and file it.
  • The decision to transfer the management for their attention to internal IMN or the Public Ministry.
  • The end result of the research carried out on the occasion of their complaint. In the event that such results could lead to the opening of an administrative proceeding or filing of legal proceedings, will be communicated to the corresponding study was conducted and its referral to the competent authority without providing information, documentation or other evidence inherent the investigation.

The above communications will be in both specified in that document its name, qualities and place of service.

Custody, access to information and communication of results shall be governed by the provisions of the provisions of Article 6 of the LGCI and Article 8 of the LCCEI, its regulations, modifications and reforms; and procedures that are established internally, in accordance with that legislation and issued by the Ministry of Environment and Energy.
